Service Mark

Service mark is relatively a new entry within the purview of the Trade Marks Act 1999. The Trade and Merchandise Marks Act 1958 had no option for the registration of service marks.  The Trade Marks Act 1999 provides statutory backing to register the service under the Trade Marks Act, 1999 separately. The major services that come within the sweep and which are now protected as a service mark in India include the likes of

  • Transport, storage and packing
  • Material treatment and processing
  • Boarding, lodging and entertainment

Once a service mark is registered, that could validate the statutory backing of protection of service mark.
