Service mark is relatively a new entry within the purview of the Trade Marks Act 1999. The Trade and Merchandise Marks Act 1958 had no option for the registration of service marks. The Trade Marks Act 1999 provides statutory backing to register the service under the Trade Marks Act, 1999 separately.
